Potential Changes in Partner Visa Australia for the 2019 year

The Migration Amendment (Family Violence and other measures) Bill was recently passed in parliament there are potential and significant changes to the Australia Partner Visa Sponsorship process that are coming soon. The potential applicants willing to apply for Partner/Spouse Visa must lodge a separate application before applying for a partner visa application. In order to move forward, this application must be approved for partner visa sponsorship.
There will be no bridging visa to allow applicants to stay in Australia while the sponsorship application processes. The sponsorship application will be implemented on or before 10 June 2019. The Australian Immigration department will provide a little warning before the changes are actually brought in. So, if you are planning to apply for Partner Visa Australia, lodge the application as soon as possible.
Australia Partner Visa

The current process of applying Australia Partner Visa involves an online application form, identity documents, and evidence of a relationship. After that, the sponsor fills out a separate sponsorship form and provides police clearance certificates and other supporting documents.
Lodging a valid partner while in Australia allows the visa applicant to obtain a Bridging Visa A which will take effect when their current visa expires. This visa allows an applicant to remain in Australia until the decision is made on the partner application. During the spouse visa Australia processing time, the BVA holder will also be entitled to Medicare and have full work rights.

Australian Citizenship Backlog Of 200,000 Applications

The Australian Immigration Department has recently announced that the government has spent $9 million to deal with an application backlog of more than 200,000 for Australian Citizenship.
Many refugees, out of which Biak Thwang Urai from Myanmar came to Australia in 2006 and lives in a modest home in Melbourne with his wife and six children. “The feeling as I arrived, I thought “this is the first sight of heaven.” We are very happy.” He told SBS News.
Mr. Urai fled Myanmar as he had been badly beaten by soldiers from the Burmese army after they had taken him on as a porter. He’d become sick and was unable to work.
“I worry that sometime the department will come and knock at the door and they’ll say ‘you need to go back to your country,” he said.
Mr. Urai applied for Australian Citizenship in 2015 to stop all the worries of going back but his papers were sent back. He has waited for five years in a refugee camp in Malaysia until he was finally granted asylum to come to Australia.
He applied again for the Australian Citizenship in 2017 and last year too where the department said that the requested birth and marriage certificate does not exist.
“We don’t have certificates because in my village there is no computers, everything no computer. My birth happened in the kitchen, not the hospital; it was very far away in the city.”
Australian Citizenship Backlog Of 200,000 Applications

Therefore, obtaining replacement documents is difficult and costly, and a challenge faced by many refugees.

Western Melbourne Chin Community President Patrick Sang Hnin says he knows about the struggles of many people in his community.
“At least 1,000 people in his community have applied to become a citizen in the last two years and I don’t know of anyone who has been granted citizenship,” he said.
What is the cause of the Australian Citizenship delays?
In April 2017, then-prime minister Malcolm Turnbull announced a citizenship crackdown, sparking a flurry of new applications. However, the applications were not processed because the Department of Immigration waited for new eligibility criteria, including hard English test to come into effect.

The government of Canberra has also replaced the ‘first-come-first-served system’ with a merit based assessment to properly address the skill needs of The Australian Capital Territory.
The state government has already been criticized since the time the program was partially closed in June this year, leaving thousands of temporary migrants and international students stranded. They wanted to apply for Australian Permanent Residency Visa but were unable to do so because of the sudden closure of the program in June this year.
The government says that international student who was eligible for state nomination when the program got closed will still be eligible to claim additional points.
The applicants that were close to become eligible for Skilled Nominated Visa 190 when the program was partially suspended in June 2018 may be eligible to claim additional points under the point-based assessment system. This transitional measure has also been mentioned on the ACT Government website. Check point scored here

In September, hundreds of international students and temporary residents demonstrated a protest against the program’s closure. The reason of their protest was the earlier migration policy under which those applicants living in Canberra for at least 12 months were eligible for state nomination for a permanent resident’s visa. The protestors also demanded to increase the number of immigration places from 800 to 1500.
The ACT Government said it consulted with various stakeholders, including program participants, migration agents, education providers, employers and others to develop the new nomination ranking system.
The new policy however will only process the application of those candidates with an in-demand occupation on the Canberra Skilled Occupation List.
Though, the details of the new policy are still unclear and the government is expecting to reveal the new program on 15th November in an information session with the migration agents.
Hence, the migrants applying for permanent residency through Canberra Skilled Migration Program sigh relief as it is opening soon. To know more in this regard, you may connect to our immigration experts by filling the free assessment form

Australia Parent Visa Processing Time Increases Due To ‘Retirement Visa’

The waiting period for parent visas is currently between six to 30 years. This is likely to increase for retiree visas now being allocated a proportion of these visas.
The Australian migrants who are awaiting the outcome of their parent’s permanent residency visa under Subclass 103 (Parent) visa or Subclass 143 (Contributory Parent) visa will have to wait longer to get the visas approved.
The visa wait is expected to get longer in the coming days for the migrants applying through outside Australia.
Australia Parent Visa

The migration Amendment (Pathway to Permanent Residents for retirement visas) will allow to permanently “regularizing” the status of ageing and different long-term residency visas like Retirement Subclass 410 and Investor Retirement (Subclass 405) visa by giving them the pathway to obtain a permanent visa.
The Retirement Visa was introduced 35 years ago to encourage self-supporting retirees to bring overseas funds into the Australian economy and spend time in Australia on their expenses at no cost to Australia’s social and welfare system.
The migrants will be able to apply for Subclass 103 (Parent) visa or a Subclass 143 (Contributory Parent) visa from 17 November 2018.
This new amendment will reduce the number of visas for parents migrating from overseas and will also increase the waiting periods which are currently between six and 30 years.
The government said that to maintain the overall planning level, people who hold a retirement visa will be allocated a proportion of visas that would have otherwise been granted to people applying for parent visas.
Thus, this will result in increasing waiting period for parent visas.
The budget review 2018-19 reads, “In addition, as people who hold retirement visas already live in Australia, and as most people who gain a parent visa currently live outside of Australia, this change will reduce the number of new migrants to Australia.”
Though, the processing time to apply for Australia parent visa will increase but the Department Home Affairs focuses on implementing in certain way that minimizes the impact on Parent Visa Programs.
The immigration department will allocate small places in the new pathway within the existing Parent Category places.
The department further added, “Pathway places will be gradually allocated over a number of years starting in 2018-19 and will not affect the overall number of Parent and Contributory Parent places in the annual migration.”
Australia is a leading immigration destination for the migrants willing to come and settle, parent visa category might be in troubling waters but there are different Australia Skilled immigration programs too that are equally acceptable.
